1.Tour Operator
The Tour Operator referred to hereafter is Petrabax/PTB Hotels.
2.Reservations
and payment
A deposit of $150 per person will be required at time of booking.
Final payment is due 45 days prior to the departure date from the USA.
It is the responsibility of the traveler (or his agent)to determine that
final payment reaches the Tour Operator on time. For bookings made within
45 days of departure date, full payment is due at time of booking. No
booking will be considered confirmed until deposit and/or full payment
is received by the Tour Operator.
3.Prices
Quoted prices are based on US Dollars and are subject to change without
notice.
4.Tour
Accommodations
The Tour Operator reserves the right, if necessary, to substitute
other similar hotels for hotels listed. Such substitutions may be made
at any time and without prior notice. The Tour Operator cannot be held
responsible for hotel over-bookings; should such occur, the Tour Operator
will undertake to find similar accommodations in the same area.
5.English-Speaking

A professional bilingual tour director will accompany tours while
traveling by motorcoach. Most tours will operate in both Spanish and English
on the same motorcoach. In the unusual event that a group numbers less
than 15 persons, the Tour Operator reserves the right to operate the tour
in minibus or private car with a bilingual driver-escort, or by first
class rail transportation.
6.Hotels
Unless otherwise stated, prices are per person and based on two persons
sharing a room with private bath. A limited number of single rooms are
available at additional cost. Triple rooms are not recommended.
7.Meals
and sightseeing
As indicated in the itineraries. Meals do not normally include beverages
except coffee or tea with breakfasts.
8.Passport
and visas
A valid passport is required for United States citizens. Citizens of other
countries require a valid passport and may require additional documents.
Such persons should contact consulates of countries to be visited and
obtain proper documents before departure. The possession of required and
valid passport and visas is the sole responsibility of the traveler. The
Tour Operator assumes no liability for lack of proper documents.
9.Baggage
Although airline regulations generally allow free of charge a maximum
of two bags with combined length, width and height of 106 inches (economy)
or 124 inches (first class); the Tour Operator will accommodate only one
normal size suitcase plus one small overnight bag on motorcoach tours.
10.Surcharges
(if applicable)
All rates published in this brochure are based on the Tour Operator issuing
traveler's transatlantic airline ticket. In the event such air transportation
is not purchased from the Tour Operator, the following surcharges will
apply: For Escorted tours, $50 per person; all other services, $25 per
person.
11.Companion
Discount
When applicable, valid only for land portion of indicated escorted motorcoach
tour departures. Transatlantic airfare MUST be purchased through Petrabax
for both traveler and companion in order to obtain this discount.
12.CANCELLATIONS,
CHANGES AND REFUNDS
Cancellations
and changes must be received by the Tour operator in writing within 60
days of travel date.
12.1)
Airfare
The airlines impose a cancellation penalty of between $150 and $ 250
on most tickets cancelled after the ticketing deadline (usually 21 days
before departure). Airlines may charge additional penalties and some
tickets are non-refundable. The Tour Operator will pass any airline
ticketing penalties, plus a $25 per ticket fee for administrative expenses,
on to the traveler. Air ticket penalties may be waived if the cancellation
is the result of illness or death of the traveler or a member of his/her
immediate family, and an official medical or death certificate is provided;
but this is not always the case.
12.2)
Escorted tours
Cancellations received more than 45 days prior to departure will have
a penalty of $50 per person; those received between 45 and 22 days will
have a penalty of $ 100 per person; those received between 21 and 16
days will have a penalty of 30% per person. Those received between 15
and 8 days will have a penalty of 50% per person. Cancellations received
within 7 days or less before departure or "no shows" will
receive no refund. No refund will be made for abandonment of services.
No refunds will be made for transfers, city tours or any other services
(including meals, accommodations or transportation) voluntarily not
taken.
12.3)
Paradores
Cancellations received more than 7 days prior to arrival will be assessed
an administrative fee of $ 50. Cancellations received within 7 days
of arrival will be assessed a penalty equal to the cost of 1 night of
accommodations in addition to the administrative fee. No refunds apply
for "no shows". Special event packages, such as the New Year's
program, are non-refundable.
12.4)
Bancotel Hotel Checks
Once full payment has been received, Bancotel hotel checks are non-refundable.
Bancotel hotel checks can be used at any participating hotels and do
not expire until March 31, 2005, subject to availability.
12.5)
Rail tickets
Once rail tickets are issued, the following penalties apply: Cancellation
received up to 7 business days of departure, a 25% penalty applies.
Cancellations received within 7 days of departure, 100% penalty applies.
Penalties are in addition to an administrative fee of $ 50.
12.6)
All other hotels and services
An administrative fee of $ 50 will be assessed for all cancellations
received more than 15 days prior to departure. Within 15 days of departure,
the hotel may impose a penalty equal to 1 night of accommodations. Some
hotels impose stiffer penalties. The tour operator will impose all hotel
penalties plus the administrative fee. During special event periods,
such as fairs and conventions, local holidays, etc., hotels may impose
no-refund policy. Consult with the tour operator.
13.Insurance
The Tour Operator highly recommends that each traveler purchase travel
and cancellation insurance. Such insurance can be obtained through your
professional travel agent.
14.Changes
Travelers holding confirmed tour or hotel package reservations may request
a change of date to another Petrabax tour or hotel package of equal or
greater value. Changes can be made up to 30 days before departure and
are subject to availability. There will be a charge of $50 per passenger
for such changes if accepted by the Tour Operator.
15.Responsibility
The Tour Operator holds itself free of any responsibility for any cause,
in all matters connected with hotels, accommodations, sightseeing tours
and transportation, whether by air, rail, bus, motorcar, boat or any other
means. The Tour Operator and/or its agents will not be responsible for
the loss or damage of any of the traveler's belongings. The Tour Operator
reserves the right to accept or retain any person as a member of a tour
at any time. Baggage and personal effects are at the owner's risk throughout
the tour unless insured.
16.Limitations
of Liability
The Tour Operator and its agents act only as agents for the traveler's
hotels, restaurants, sightseeing and
transportation (such as railroad, aircraft, boat, motorcoach, automobile,
or any conveyance). The Tour Operator and its agents shall not be responsible
or liable for any injury, loss or damage, delay or inconvenience arising
out of or in connection with any defect in any vehicle or any act, omission,
neglect, accident, error or default of any company or person engaged in
providing such hotel, restaurant, sightseeing, transportation or other
services of the tour. The Tour Operator and its agents shall not be responsible
or liable for alterations of the tour itinerary or arrangement, if such
alterations become advisable or necessary for the comfort or well being
of any passenger, or for any reason whatsoever. The right is reservedto
withdraw any or all tours or portions thereof. The sole and exclusive
responsibility and liability of the airline shall be in accordance with
and as limited by the contract of carriage in the passenger's ticket,
the applicable tariffs, and provisions of the Warsaw Convention, if applicable.
The airline shall not be responsible or liable for any act, omission or
occurrence not limited to hotel accommodations, restaurants, guide services
and transportation (other than the airline) that are furnished by contractors
that are independent and that do not act on behalf of the airline, are
not servants of the airline, and with whom the airline does not have any
business relationships, as joint ventures or otherwise. Further, the airline
shall not be responsible or liable in any way for the accuracy of representations
of the Tour Operator and its agents on tour services other than those
contained in the brochure. The services of any I.A.T.A.N. or A.R.C carrier
may be used in the performance of these tours, and references to the airline
herein shall be equally applicable to such I.A.T.A.N. or A.R.C. carrier.
